A report was recently published which announced a yearly analysis of reported electronic discovery opinions and notable e-discovery themes in 2011.
From Jan. 1, 2011 to Oct. 31, 2011, this report, written and funded by the Kroll Ontrack organization, summarized 92 cases – some of the most significant state and federal judicial opinions on the topics of preservation and production of electronically stored information (ESI).
The breakdown of the major issues involved in these cases are expressed in the following two (2) charts below;

Three notable emerging case themes were also observed as coming out of this 2011 study — taxation of e-discovery related costs, social networking, and e-discovery in criminal actions – will certainly be the topic of much discussion moving into 2012…..
